By accessing or using SwaVid, you agree to these Terms and Conditions. If you use SwaVid on behalf of a child, school, institution, company, or other organisation, you represent that you have authority to accept these Terms for that user or organisation. SwaVid provides educational diagnostics, AI-assisted learning recommendations, personalised tutoring, curriculum-gap analysis, learning analytics, parent and student reports, and school tools. SwaVid is an educational technology service. It does not provide medical, psychological, psychiatric, therapeutic, clinical, legal, financial, admission, or exam-certification advice. SwaVid does not guarantee grades, marks, rank, exam performance, school admission, scholarship outcomes, learning improvement, or any other academic result. Outcomes depend on student effort, prior knowledge, learning environment, health, access, consistency, curriculum, teacher support, and other factors outside SwaVid control. AI-generated explanations, reports, recommendations, hints, and tutoring responses may be incomplete, incorrect, biased, delayed, unsuitable, or unavailable. Users must not rely on SwaVid as the sole basis for important educational, psychological, medical, disciplinary, or academic decisions. Parents, guardians, teachers, and qualified educators remain responsible for reviewing important decisions involving a child. Paid features, trials, subscriptions, school plans, and partner plans may be subject to separate order forms, pricing pages, invoices, payment-processor terms, cancellation rules, and refund terms. The Refund and Cancellation Policy forms part of these Terms. Taxes, payment failures, renewal dates, and payment-method updates remain the responsibility of the purchaser unless a written school or partner agreement states otherwise. SwaVid and its software, assessments, reports, design, curriculum maps, diagnostics, learning flows, generated templates, trademarks, service marks, logos, documentation, and platform content are owned by SwaVid or its licensors. Users retain ownership of their personal data and lawful user-submitted content. By submitting content, users grant SwaVid a limited licence to host, process, transmit, display, analyse, and use the content to provide and improve the service, subject to the Privacy Policy and applicable law. SwaVid may use aggregated, anonymised, or de-identified data to improve educational quality, safety, reliability, analytics, and product performance. We do not use identifiable child data for unrelated advertising or model training unless legally permitted and properly authorised. We may suspend or terminate access where reasonably necessary due to misuse, non-payment, fraud, security risk, legal risk, child-safety concern, violation of these Terms, or requests from an authorised school or legal authority. SwaVid is provided on an "as is" and "as available" basis to the maximum extent permitted by law. We disclaim warranties that the service will be uninterrupted, error-free, perfectly accurate, secure, or suitable for every student or curriculum. To the maximum extent permitted by law, SwaVid shall not be liable for indirect, incidental, special, consequential, exemplary, punitive, or loss-of-profit damages. Nothing in these Terms excludes liability that cannot be excluded under applicable law. These Terms are governed by the laws of India. Subject to mandatory consumer, child-protection, privacy, or education-law rights that apply in a user jurisdiction, disputes shall be subject to the competent courts at the jurisdiction of the registered office of Swavid Edutech Private Limited, unless a separate written agreement states otherwise. Users outside India retain non-waivable rights under applicable local law. A person creating a parent, guardian, teacher, school, administrator, or partner account represents that all registration information is accurate, current, and complete, and that the person has the legal capacity and authority to bind the relevant user, child, school, institution, company, or organisation. A child account may be created only by a parent, guardian, school, or other legally authorised adult, or through a workflow approved by such adult. SwaVid may suspend or restrict any student account if SwaVid reasonably believes that lawful consent or authority is absent, defective, withdrawn, disputed, or unverifiable. If SwaVid is accessed under a school, institutional, pilot, reseller, or partner arrangement, the signed agreement, order form, purchase order, data processing terms, and school policies may impose additional obligations. In case of conflict, the signed agreement controls for that customer to the extent legally enforceable. SwaVid assessments, diagnostics, readiness maps, cognitive indicators, learning-debt outputs, concept mastery scores, AI explanations, lesson flows, parent reports, teacher dashboards, and school analytics are designed for educational guidance. They are not guaranteed to be complete, error-free, clinically validated, exam-certified, school-board-approved, or appropriate for every student. Users must not represent SwaVid reports as medical diagnosis, disability diagnosis, psychological evaluation, legal evidence, official school transcript, admission credential, board result, or guaranteed prediction of academic performance. Any high-impact educational decision should be reviewed by a qualified human educator and, where relevant, a parent, school, counsellor, or professional. SwaVid may modify, remove, retire, replace, or reclassify any content, feature, diagnostic, learning path, question, report format, AI model, voice tool, dashboard, or curriculum coverage without liability, provided such changes do not remove paid rights in a manner prohibited by applicable law or signed agreement. Users must not upload, transmit, request, generate, or encourage content that is unlawful, exploitative, sexually explicit involving minors, abusive, discriminatory, hateful, self-harm promoting, violent, deceptive, privacy-invasive, infringing, malicious, or otherwise incompatible with a child learning environment. Users must not use SwaVid to conduct surveillance of a child outside legitimate educational or parental purposes, shame or publicly rank a child, disclose another child data, manipulate a child, extract hidden prompts, bypass safety systems, perform credential attacks, scrape content, interfere with service operation, or use SwaVid outputs for cheating in restricted examinations. SwaVid may remove content, restrict features, suspend accounts, preserve evidence, notify schools or parents, report to authorities, or terminate access where SwaVid reasonably believes the service is being used in a way that threatens safety, security, privacy, children welfare, contractual compliance, or legal obligations. SwaVid relies on third-party providers for hosting, cloud infrastructure, databases, AI models, speech services, email delivery, messaging, analytics, observability, payments, support, authentication, storage, and other functions. SwaVid is not responsible for third-party outages, policy changes, model behaviour, payment-provider delays, app-store delays, network failures, or school-system integration failures except to the extent required by law or contract. SwaVid may change providers, models, infrastructure, or integration methods for security, quality, cost, legal, reliability, or product reasons. Such changes may alter latency, available voices, output style, report polish, feature availability, or geographic processing locations, subject to applicable notices and contractual commitments. To the maximum extent permitted by law, users, schools, partners, and organisations shall indemnify and hold SwaVid harmless from claims arising from unauthorised student onboarding, unlawful consent, misuse of the service, user content, breach of these Terms, infringement, payment disputes, violation of school policy, violation of applicable law, or use of SwaVid outputs outside the permitted educational context. SwaVid remedies may include warning, feature restriction, content removal, account suspension, account termination, refund denial where lawful, reporting to school administrators, reporting to payment processors, reporting to competent authorities, and preservation of records necessary for legal claims or safety investigation. Nothing in these Terms limits statutory rights that cannot be waived, including mandatory consumer rights, children privacy rights, data protection rights, school privacy rights, or liability that cannot be excluded under applicable law.
