This Student Data Protection Agreement summary describes SwaVid baseline commitments for student information. School-specific terms should be captured in a signed agreement.

Where SwaVid receives education records from a US school, the parties should configure the relationship to support FERPA requirements, including authorised disclosure, school control, legitimate educational interest, confidentiality, and deletion or return at contract end as applicable.

Student data remains controlled by the parent, eligible student, school, institution, or other authorised controller as applicable. SwaVid does not claim ownership of identifiable student personal data, education records, or school records.

SwaVid may use student data only to provide, maintain, secure, support, personalise, and improve the educational services, or as otherwise permitted by the written agreement, parent consent, school instruction, or applicable law.

SwaVid shall not disclose student data to unauthorised third parties. Disclosures may occur to authorised parents, guardians, teachers, school administrators, contracted service providers, legal authorities, or other recipients permitted by law and agreement.

Upon valid request or contract termination, SwaVid will delete, return, restrict, anonymise, or de-identify student data as required by the applicable agreement and law, subject to legal retention, security logs, backup cycles, fraud prevention, accounting, and dispute needs.
